If you suspect a nonlawyer of practicing law without a license in Hawai’i, the first step is to contact the State Bar’s Authorized Practice Committee. Generally, the committee is charged with investigating suspected unauthorized practice of law. It can also take disciplinary action against a nonlawyer. The committee can issue a cease and desist letter, refer the matter to other authorities, and pursue an injunction. Moreover, the committee may request a statement from the nonlawyer in order to determine whether or not the practice is legal.
When a complaint is received, the State Bar staff will review the complaint and present its findings to the Authorized Practice Committee. A committee member will then consider the information and decide whether or not the action should be taken. In the event that the committee does not take any disciplinary action, a summary of the complaint will be sent to the nonlawyer. After receiving the summary, the nonlawyer may respond to the committee’s request. Once a response has been received, the committee will take appropriate action.
Unlike other jurisdictions, the practice of law in Hawai’i is not formally defined by the Hawai’i Supreme Court. While this lack of formal definition is not necessarily problematic, it does mean that it is not covered by all possible enforcement actions.
